Konvertza is a product of Hatchd Digital Innovations (Pty) Ltd, a company registered in South Africa and trading under the name "Konvertza" and "Konvertza by Hatchd".

We provide an AI-powered lead management, content scheduling, and marketing automation platform designed specifically for real estate agents.

2. Scope of This Policy

This Privacy Policy explains how we collect, use, store, share, and protect personal information when you use Konvertza, whether you are:

  • A real estate agent who subscribes to and uses the Konvertza platform ("Agent"); or
  • A lead whose information has been processed through the platform because an Agent is managing their relationship with you ("Lead").

This policy is drafted in compliance with the Protection of Personal Information Act, 2013 (POPIA) of South Africa.

3. Personal Information We Collect

3.1 Information Collected from Agents

When you register and use Konvertza as an Agent, we collect:

  • Contact details: Full name, email address, and phone number
  • Business information: Business name and address
  • Identity verification: South African ID number, collected for the purpose of verifying your identity during onboarding
  • Billing information: Banking details required for subscription billing, processed via PayFast
  • Platform access tokens: Meta OAuth tokens that authorise Konvertza to post content and send messages on your behalf via Facebook, Instagram, and WhatsApp
  • Brand and business preferences: Your brand voice profile, tone preferences, target audience settings, and other business customisations you configure within the platform

3.2 Information Processed About Leads

When Agents use Konvertza to manage their leads, the platform may process the following information about those individuals:

  • Contact details: Name and phone number
  • Communication content: WhatsApp message content exchanged between the lead and the Agent
  • AI-generated data: Intent classification scores and conversation analysis generated by our AI processing pipeline
  • Engagement history: Records of interactions, responses, and conversation history within the platform

We act as an operator in respect of Lead data. The Agent who has collected that Lead’s information is the responsible party for the purposes of POPIA.

4. Why We Collect This Information

We collect and process personal information for the following purposes:

  • To create and manage your Konvertza account
  • To provide AI-powered lead management and conversation analysis services
  • To enable automated content scheduling and posting to Meta platforms on your behalf
  • To process subscription payments and manage billing
  • To verify your identity during onboarding
  • To improve and maintain the performance and security of the platform
  • To comply with legal obligations, including POPIA and applicable financial regulations

We do not use personal information for unsolicited marketing or sell it to third parties for advertising purposes.

5. Who We Share Your Information With

We share personal information only with the third-party service providers necessary to deliver our platform:

  • Meta Platforms (Facebook, Instagram, WhatsApp Business API) for content publishing and messaging
  • Google Cloud Platform for hosting, storage, and operational infrastructure
  • Google Sheets for per-agent data storage
  • Anthropic (Claude AI) for conversation analysis and content generation
  • PayFast for subscription billing and payment processing

Each of these providers operates under their own terms of service and privacy policies. We do not authorise these providers to use your personal information for their own independent marketing purposes.

We may also disclose personal information where required by South African law, court order, or regulatory authority.

6. Cross-Border Transfers

Some of the third-party providers listed above are based outside of South Africa. By using Konvertza, you acknowledge that your data may be transferred to and processed in jurisdictions with different data protection laws. Where we transfer data internationally, we take reasonable steps to ensure it is handled with an appropriate level of protection, consistent with POPIA.

7. Data Retention

  • Personal information for active accounts is retained for the duration of your subscription and for five (5) years thereafter, for legal and compliance purposes.
  • If you submit a deletion request, your personal information will be removed within 30 days of that request being verified and processed, unless we are required by law to retain certain records.
  • Lead data managed on behalf of an Agent is subject to the same retention schedule and will be deleted upon a valid request from the relevant data subject.

8. Security

We implement reasonable technical and organisational measures to protect personal information against loss, unauthorised access, disclosure, alteration, or destruction. These measures include access controls, encrypted data transmission, and regular security reviews.

No system is completely secure, however, and we cannot guarantee absolute security. If you have reason to believe your personal information has been compromised, please contact us immediately at info@konvertza.co.za.

9. Your Rights as a Data Subject

Under POPIA, you have the following rights in relation to your personal information:

  • Access: Request a copy of the personal information we hold about you
  • Correction: Ask us to correct inaccurate or incomplete information
  • Deletion: Request that we delete your personal information, subject to any legal retention obligations
  • Objection: Object to the processing of your personal information in certain circumstances
  • Complaint: Lodge a complaint with the Information Regulator of South Africa if you believe your rights have been violated

10. Cookies and Tracking

Our web platform may use cookies and similar technologies for session management and basic analytics. We do not use tracking technologies for behavioural advertising.

11. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our services, legal requirements, or data practices. When we make material changes, we will notify you via email or a notice within the platform. The "Last updated" date at the top of this document will always reflect the most recent version.

Continued use of Konvertza after any changes constitutes your acceptance of the updated policy.
